Initiative for a settlement agreement?

Parties have, among other things, tried to resolve or eliminate their differences of opinion by conducting various discussions but have not succeeded in doing so. As a result of the irreconcilable difference of opinion and the absence of a suitable alternative position, the employer takes the initiative to terminate the employment contract.

The preceding provision, or a similar provision, should be included in the recitals of a settlement agreement. It is important that it is clear to the UWV that the initiative for terminating the employment relationship lies with the employer. If this is clear, then the UWV will judge that there is no culpable unemployment on the part of the employee. Ultimately, that is often the most important point in a settlement agreement for the employee.

In some cases, the initiative for termination does not lie with the employer but actually with the employee. For example, because the employee has indicated that he/she is no longer able to perform the work (well). This may be due to the situation at work, but also to a difficult home situation. In those cases, it is pleasant for an employee that he/she can still claim a ui-benefit. By resigning, the employee loses that claim in any case. The UWV will then judge that the employee is culpably unemployed. We can help to draft the settlement agreement in such a way that the UWV, based on the policy rules, cannot conclude that there is culpable unemployment. So show initiative and as an employee, always have your settlement agreement checked by a knowledgeable jurist.
